DISCLAIMER AND INDEMNITY

The Florida Academy of Family Physicians (FAFP) has provided this e-mail list service over the Internet for the convenience of its members, staff and certain other authorized individuals. The list is provided merely as a forum for enabling participants to communicate about subjects of interest. The FAFP does not exert editorial control over information or materials posted by third parties onto this list service or information or materials that are e-mailed by third parties to any other parties. The FAFP is not responsible for monitoring any materials posted by any third party or for verifying that such information or materials are accurate, timely, reliable, suitable, complete, non-infringing or free from technical defects.

The FAFP accepts no responsibility for, and expressly disclaims all warranties and representations of any kind, express or implied, regarding, the use, operation or performance of the e-mail discussion list or any information or materials posted through the list, including warranties of merchantability, fitness for a particular purpose, title and non-infringement.

In no event shall the FAFP be liable for any direct, indirect, punitive, incidental, special, consequential or any other damages whatsoever arising out of or in any way connected with (1) the use, operation or performance of the list, (2) the delay or inability to use the list in whole or in part, (3) any reliance by you on information or materials provided on or through this list, or on the reliability, accuracy, completeness, suitability or timeliness thereof, (4) any unauthorized use by you or others of the list, or (5) termination or modification by the FAFP of the list or any information or materials provided on it, whether based on contract, tort, negligence, strict liability or otherwise, even if the FAFP has been advised of the possibility of such damages.

In addition to and without limiting the foregoing, the FAFP shall not be liable for any harm caused by the transmission, via use of the list, of a computer virus, or other computer code or programming device that may be used to access, modify, delete, damage, corrupt, deactivate, disable, disrupt, or otherwise impede in any manner the operation of any of your software, hardware, data or property.

You are solely responsible for the content of any e-mails you post to the list service and you agree to indemnify and hold the FAFP, its affiliates, officers, agents and employees, harmless from any claim, demand or expense (including attorneys' fees) due to or arising out of your use of the list service or of any information or materials provided via the list service. List service members must provide a “signature” that identifies, at a minimum, their true first and last names, the jurisdiction in which they practice or live, and their e-mail address. You signify your agreement to the terms of this Disclaimer and Indemnity by utilizing the list service.



GUIDELINES

1. Only information which may be expected to be of interest to FAFP members by virtue of its relevance to either (1) clinical and socioeconomic issues in medicine or (2) FAFP-related activities should be posted.

2. The FAFP accepts no responsibility for the opinions or information posted by users.

3. Do not post any false, inaccurate, misleading, defamatory, tortious, abusive, threatening, harassing, profane, obscene, offensive, pornographic, hateful, infringing, anti-competitive or illegal information or materials. The FAFP does not condone and will not be responsible for any such information or materials or for any resulting liability. Any communication regarding salaries or pricing (including negotiations with payers), or specific patient-identifiable health information, is prohibited.

4. The FAFP does not actively monitor the list for inappropriate postings and does not, on its own, undertake editorial control of postings. However, in the event that any inappropriate posting is brought to the FAFP’s attention, the FAFP may, but is not required to, remove all or part of the posting and/or terminate a user's access to the list. The FAFP reserves the right to reveal your identity (or whatever information it may know about you) in the event of a complaint or legal action arising from any e-mails posted by you.

5. Do not post any information, software or other material protected by copyright, patent, trademark, trade secret or other proprietary right without the permission of the rights owner. By posting information, software or other material, the posting party warrants and represents that it owns such rights in the information, software or other material, or has received permission from the person or entity who owns such rights, in the information, software or other material. By posting information, software or other material, the posting party grants the FAFP and other subscribers to the list service the non-exclusive right and license to display, copy, publish, distribute, transmit, print and use such information, software or other material. Subject to the grant of this license, the posting party retains any other rights that the party may have in such information, software or other material.

6. Do not post any information or materials which contain any virus, trojan horse, corrupted file, worm, time bomb, cancelbot or other computer programming routine that is intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or information.

7. Because this electronic mailing list is not monitored by the FAFP, do not use it to send messages to the FAFP. E-mail may be sent to the FAFP at the following address: doctorslounge@fafp.org.

8. The FAFP reserves the right to terminate access to any user who does not abide by these guidelines. The FAFP may modify, suspend or discontinue, on a temporary or permanent basis, the list service at any time for any reason. All rights of termination shall be within the sole discretion of the FAFP.

9. The FAFP is a "service provider" of this electronic mailing list, as that term is defined in the Digital Millennium Copyright Act of 1998. Any notices under this law should be directed to Tad P.
